A North Korean defector, identified as A, has made headlines for donating his entire first salary to support victims of the recent wildfires in the Gyeongsang provinces. The 40-year-old public servant, who escaped from North Korea six years ago, contributed 2 million won (approximately $1,500) to aid those affected by the devastating fires in North Gyeongsang and South Gyeongsang. 

Having settled in South Korea alone, A was appointed as a public servant in Seongnam City in December of last year, where he works in social welfare, providing support and counseling for North Korean defectors. Despite having no personal ties to the affected areas, A felt compelled to help, expressing his gratitude in a heartfelt handwritten letter accompanying his donation. He wrote, "I have never contributed a brick to this country or planted a tree, yet I am able to live well thanks to the love and attention of many people. Although it is not a large sum, I want to contribute to those in need in South Korea."

Reflecting on the kindness he has received, A shared, "Seeing people from different backgrounds smile and share in our pain made me realize how fortunate I am to live in such a wonderful place. I want to repay this precious love."

He also expressed his sorrow over the loss of lives among public servants during the wildfires, stating, "Many people are suffering due to the recent disaster, and it breaks my heart to know that several public servants lost their lives. Yoon Jong-shin Shines as a Legend on KBS2's 'Immortal Songs'

In a recent ruling, South Korea's Supreme Court determined that the statute of limitations (10 years) for claims regarding unauthorized use of music in online games must be calculated on a daily basis from the date the music was used. The Supreme Court's first division, led by Justice Roh Kyung-pil, announced on April 6 that it had overturned part of a lower court's ruling in a case brought by music copyright holder Chesky Productions against game developer HanbitSoft. 

HanbitSoft had commissioned a third-party developer in 2006 to create a game, during which the developer used Chesky's music without permission in certain scenes. The game was released in December 2008, and HanbitSoft later absorbed the third-party developer. 

Chesky raised concerns about the unauthorized use of its music after the game's release, but it wasn't until May 2016 that HanbitSoft removed the music from the game. In 2021, Chesky filed a lawsuit seeking the return of 40 million won in profits that HanbitSoft allegedly gained from copyright infringement. 

The first trial acknowledged HanbitSoft's unauthorized use of the music and ordered the company to return 25 million won to Chesky. The court ruled that the state of unjust enrichment continued until the music was removed in May 2016, and since the lawsuit was filed within the 10-year statute of limitations, the claim was valid. The appellate court upheld this decision. 

However, the Supreme Court took a different stance on the timing of the claim's establishment and the calculation of the statute of limitations. It stated that HanbitSoft continuously profited from the unauthorized use of the music from the game's release in December 2008 until its removal in May 2016. Therefore, the claim for unjust enrichment was established daily during that period, and the statute of limitations would also progress separately. 

The Supreme Court noted that there were grounds to overturn the lower court's ruling regarding the portion of the claim that had already exceeded the 10-year statute of limitations, instructing the lower court to recalculate the unjust enrichment amount excluding that portion.

최근 한국 대법원은 온라인 게임에서 음악의 무단 사용에 대한 청구의 소멸시효(10년)가 음악이 사용된 날짜부터 일일 기준으로 계산되어야 한다고 판결했다. 대법원 제1부는 노경필 판사의 주재 하에 4월 6일 음악 저작권 보유자인 체스키 프로덕션이 게임 개발사 한빛소프트를 상대로 제기한 사건에서 하급 법원의 판결 일부를 뒤집었다고 발표했다.

한빛소프트는 2006년에 제3자 개발자에게 게임 제작을 의뢰했으며, 이 과정에서 개발자는 특정 장면에서 체스키의 음악을 허가 없이 사용했다. 이 게임은 2008년 12월에 출시되었고, 한빛소프트는 이후 제3자 개발자를 흡수했다.

체스키는 게임 출시 후 음악의 무단 사용에 대해 우려를 제기했지만, 한빛소프트가 2016년 5월에 게임에서 음악을 제거할 때까지는 아무 조치를 취하지 않았다. 2021년, 체스키는 한빛소프트가 저작권 침해로 얻은 4천만 원의 이익 반환을 요구하는 소송을 제기했다.

1심은 한빛소프트의 음악 무단 사용을 인정하고 회사에 체스키에게 2천5백만 원을 반환하라고 명령했다. 법원은 부당이득의 상태가 2016년 5월 음악이 제거될 때까지 계속되었으며, 소송이 10년 소멸시효 내에 제기되었기 때문에 청구가 유효하다고 판결했다. 항소 법원은 이 결정을 유지했다.

그러나 대법원은 청구의 성립 시점과 소멸시효 계산에 대해 다른 입장을 취했다. 대법원은 한빛소프트가 2008년 12월 게임 출시부터 2016년 5월 음악 제거까지 무단 사용으로 지속적으로 이익을 얻었다고 밝혔다. 따라서 부당이득 청구는 그 기간 동안 매일 성립되었으며, 소멸시효도 별도로 진행될 것이라고 설명했다.

대법원은 이미 10년 소멸시효를 초과한 청구 부분에 대해 하급 법원의 판결을 뒤집을 근거가 있다고 언급하며, 해당 부분을 제외한 부당이득 금액을 재계산하라고 하급 법원에 지시했다.
