Kim Hak-ki (김학의), the former Vice Minister of Justice, has been awarded over 100 million won in criminal compensation after being acquitted of charges related to sexual bribery and solicitation. The Seoul High Court's Criminal Division 4-2, presided over by Judge Kwon Hyuk-jung, confirmed on May 8 that Kim will receive 125.1 million won for his detention and an additional 8.995 million won for related expenses. 

Criminal compensation is a system that reimburses defendants for damages incurred during wrongful detention when they are ultimately found not guilty. 

Kim was embroiled in controversy shortly after his appointment as Vice Minister in March 2013, facing allegations of receiving sexual services from a construction businessman, Yoon. He underwent two investigations by the prosecution in 2013 and 2014 but was cleared of charges. However, in 2019, then-President Moon Jae-in urged a thorough investigation, leading to renewed scrutiny and charges of receiving 43 million won in cash and phone bills from businessman Choi. 

The judicial outcomes varied over time. Initially, Kim was acquitted, but the second trial found him guilty, sentencing him to 2 years and 6 months in prison along with a fine of 5 million won. The Supreme Court later questioned the credibility of Choi's testimony, sending the case back for retrial. In the retrial, while acknowledging the evidentiary value of Choi's statements, the court concluded that they lacked sufficient credibility to eliminate reasonable doubt, resulting in Kim's acquittal. The Supreme Court finalized the not guilty verdict in August 2022, concluding a lengthy legal battle spanning five trials. 

Throughout this ordeal, Kim was detained and released after the first trial's acquittal, then re-arrested following the second trial's conviction, ultimately spending approximately 14 months in custody. The core allegations of sexual solicitation were dismissed due to the expiration of the statute of limitations or lack of evidence. The Supreme Court confirmed that the allegations of receiving sexual services from Yoon between 2006 and 2008 were time-barred, and other bribery charges were also ruled as not guilty.

Furthermore, from January 2019 to November 2023, they also colluded on bids for procurement services issued by the Defense Logistics Agency (DLA), agreeing on the winning bidder and bid prices before submission.

This case marks a notable collaboration between South Korean prosecutors and the U.S. Department of Justice, following a Memorandum of Understanding (MOU) on antitrust enforcement signed in November 2020. The investigation is highlighted as the first instance of simultaneous investigations conducted by both countries, with evidence shared through international legal cooperation mechanisms. Prosecutors emphasized that the complexity of the case required cooperation between South Korean and U.S. authorities to uncover the full extent of the collusion, as evidence was dispersed across both nations.

Investigations have revealed that Moon Jae-in's daughter, Moon Da-hye, was a member of both the Democratic Party and the Justice Party during her father's presidency. The National Police Agency's investigation uncovered that the head of the National Security Office advised her to resign from the Democratic Party after concerns arose about the potential negative impact on the president's administration due to her dual membership. 

According to the indictment submitted by the Ministry of Justice, the situation escalated when Moon Da-hye's membership in the Justice Party was widely reported in January 2018, raising suspicions about her dual affiliation. A prosecutor stated that evidence confirming her membership in the Democratic Party was obtained through seizures, noting that belonging to multiple parties is illegal, but they did not pursue charges due to the statute of limitations.

The investigation also indicated that Moon Jae-in assisted his son-in-law, Seo Mo, in securing various jobs as the couple faced financial difficulties. The indictment detailed that in February 2016, after Seo failed repeatedly in law school admissions and his marriage deteriorated, Moon Jae-in facilitated his employment at 'Tori Games' through a former administrative officer from his administration.

Despite a monthly salary of 2.6 million won, the couple struggled to meet their average monthly expenses of over 6 million won, relying on 4 million won in monthly support from Seo's mother. However, as her financial situation worsened, the support ceased, and by late January 2018, the couple's total savings dwindled to just 2 million won.

Subsequently, Moon Jae-in helped Seo secure a position at Thai low-cost airline Thai AirAsia, where he earned a total of 217 million won from August 2018 to April 2020. The Presidential Security Service reported Seo's employment and the security plans for Moon Da-hye's family in Thailand to the former president, who approved them.

On April 24, the Jeonju District Prosecutor's Office indicted Moon Jae-in on bribery charges without detention, alongside former lawmaker Lee, who allegedly provided favors to the family. Moon Da-hye and Seo received deferred prosecution. In response, Moon Jae-in criticized the investigation as politically motivated, claiming it was designed to harass and humiliate him and his family. 한 달 급여가 260만 원에도 불구하고, 이 부부는 평균 월 지출이 600만 원이 넘는 상황에서 서모의 어머니로부터 매달 400만 원의 지원에 의존해야 했다. 그러나 그녀의 재정 상황이 악화되면서 지원이 중단되었고, 2018년 1월 말까지 이 부부의 총 저축액은 200만 원으로 줄어들었다.

그 후 문재인은 서모가 태국 저가 항공사인 타이 에어아시아에서 일자리를 확보하도록 도왔고, 그는 2018년 8월부터 2020년 4월까지 총 2억 1천7백만 원을 벌었다. 검찰은 이 지급을 문재인에 대한 뇌물로 분류했다. 대통령 경호실은 서모의 고용과 문다혜 가족의 태국에서의 경호 계획을 전 대통령에게 보고하였고, 그는 이를 승인했다.

4월 24일 전주지검은 문재인을 구속 없이 뇌물 혐의로 기소했으며, 가족에게 특혜를 제공한 혐의를 받는 전 의원 이와 함께 기소되었다. 문다혜와 서모는 기소유예를 받았다. 이에 대해 문재인은 조사를 정치적 동기로 비판하며, 자신과 가족을 괴롭히고 모욕하기 위한 것이라고 주장했다. 그는 이후 관련 검찰에 권력 남용 및 정보 유출에 대한 고소를 제기했다.
