The Supreme Court of South Korea has confirmed a lower court's ruling that partially favors the wife of Kwon Do-hyung (34), the CEO of Terraform Labs, who is a central figure in the collapse of the virtual currencies Terra and Luna. The ruling, issued on May 8, 2025, stems from a lawsuit filed by Kwon's wife, Lee Mo, against the government regarding the seizure of her real estate shares and officetel pre-sale rights.

The Terra-Luna incident refers to the dramatic drop in value of the cryptocurrencies Terra and Luna, which Kwon had claimed were 'safe,' plummeting to nearly zero in May 2022, resulting in significant losses for investors. The prosecution sought asset seizure based on the Anti-Asset Forfeiture Act, citing violations of capital market laws against Kwon, and the court approved the seizure of approximately 233.3 billion won. This included the real estate shares and pre-sale rights held in Lee's name.

Following this decision, the government registered a provisional seizure on the couple's jointly purchased apartment, Galleria Foret, located in Seongsu-dong, which they acquired for 4.2 billion won in March 2021, with Lee holding 10% and Kwon 90% of the ownership.

In September 2023, Lee filed a lawsuit claiming that the shares of the apartment and the pre-sale rights for an officetel valued at approximately 1.86 billion won were purchased with her own funds. In June 2024, the first trial ruled in her favor, stating that since the acquisitions occurred during the couple's marriage (they married in 2020), they were presumed to be her separate property, thus the seizure should not apply.

However, in December 2024, the second trial rejected her claim to the apartment shares but upheld her ownership of the officetel pre-sale rights, stating that the apartment shares were effectively purchased with Kwon's funds and were thus considered his property.

The Supreme Court agreed with the second trial's assessment, dismissing the case without further hearings, thereby upholding the lower court's decision.

On May 9, a group of ten experts, including Professor Jeong Soon-dul from Ewha Womans University, Song Jae-chan, Secretary General of the Korean Senior Citizens Association, and Lee Yoon-hwan, President of the Korean Gerontological Society, officially proposed raising the current senior age threshold from 65 to 70 years. This recommendation was outlined in a document titled 'Social Proposal on the Age Standard for Seniors.' 

The experts have been engaged in discussions since February during a series of meetings organized by the Ministry of Health and Welfare, focusing on the appropriate age for seniors. However, as discussions stalled under the current government, they decided to consolidate their views and present this proposal. 

In their document, they noted that the Senior Welfare Act, which established the age of 65 for seniors, was enacted 44 years ago in 1981. They emphasized that many aspects of society have changed since then. They pointed out that the issues of low birth rates and an aging population are expected to worsen, leading them to conclude that the appropriate age for seniors should now be set at 70. 

The experts provided several justifications for this change, including an increase in life expectancy from 67.9 years in 1981 to 83.5 years today, and the current health status of 70-year-olds being comparable to that of 65-year-olds a decade ago. They also highlighted that if the age of 15 years of remaining life expectancy is used as a benchmark, the senior age has risen from 62 in 1980 to 73 in 2023. 

Surveys conducted on the perceptions of seniors have shown that since 2011, individuals aged 65 and older have consistently identified the age of 70 as the threshold for being considered a senior. In 2023, this average rose to 71.6 years. A recent survey by the Korea Institute for Health and Social Affairs indicated that respondents aged 50 to 64 agreed that the senior age should be adjusted to 69.8 years. 

However, the experts cautioned against overlooking the high poverty rates among seniors and the inadequate preparation for retirement in South Korea. They stressed the need to extend employment periods for primary jobs to prevent income gaps for seniors and to create opportunities for them to participate in the labor market based on their capabilities and needs. Many retirees face a three-year income gap between the end of their employment and the start of pension benefits, highlighting the necessity for stable income before entering old age. 

They also argued for a gradual increase in the ages for pension enrollment and benefits. Currently, the age for receiving the National Pension is set at 63, with plans to adjust it to 65 by 2033. They suggested considering a proposal to raise it to 68 by 2048, as recommended by the 5th National Pension Financial Calculation Committee. Additionally, they proposed increasing the eligibility age for the Basic Pension to 66 starting in 2030, with a plan to raise it by one year every two years until it reaches 70 by 2040. 

Furthermore, they recommended that the age threshold for senior citizen benefits, such as free subway rides, should also be raised, but applied flexibly based on income, assets, and regional factors. They emphasized that even with adjustments to the senior age standard, access to healthcare and long-term care services should continue to be guaranteed based on health status and care needs. 

The experts called for a systematic review and adjustment of the senior age standard every five years, taking into account various indicators such as health levels, economic and social activities, poverty rates, societal perceptions, and the dependency ratio of the elderly. 

While this proposal marks the first official recommendation for raising the senior age, Lim Eul-ki, the Director of the Elderly Policy Division at the Ministry of Health and Welfare, noted that the implications of such a change are significant and that further discussions will be necessary after the new government takes office to determine policy direction.

Despite the postponement of Lee Jae-myung's trial regarding the Public Official Election Act until after the presidential election, the Democratic Party continues its aggressive stance against the judiciary. On May 8, the party announced plans to propose a special investigation law to uncover allegations of election interference against Chief Justice Cho Hee-dae. Additionally, a hearing is scheduled for May 14, where both Cho and other Supreme Court justices will be summoned to the National Assembly. The party has openly called for Cho's resignation, indicating a desire to hold accountable the justices who ruled against Lee on May 1.

Legal experts have expressed concern over this unprecedented pressure on the judiciary. Kim Dae-gwang, Secretary-General of the Legal Ethics Council, former judge Kim Ik-hyun, and Professor Han Sang-hoon, former president of the Korean Criminal Law Association, shared their differing views on the situation.

Kim Dae-gwang stated that the Democratic Party's attacks on the judiciary could instill a primal fear among legal professionals. He criticized the party for questioning why a guilty verdict was issued against a leading presidential candidate just before the election, arguing that the real issue is why a case involving allegations of false statements from three years ago remains unresolved. He suggested that the justices may have postponed the trial to avoid political misunderstandings, fearing that a sitting president could influence the proceedings.

The Democratic Party's threats of impeachment against the Chief Justice and other judges, as well as their calls for hearings, are alarming. If Chief Justice Cho were to face such scrutiny, it could create a chilling effect on judges and lawyers, leading them to feel that a powerful opposition party is undermining the rules of justice. This could severely compromise the independence of the judiciary.

The party is also pushing for amendments to the criminal procedure law that would halt trials if a defendant is elected president, as well as changes to election laws that would remove certain charges against Lee. Kim questioned whether the party would still advocate for reform if Lee were acquitted by the Supreme Court, emphasizing the need for caution when altering laws that protect citizens' rights.

Kim Ik-hyun raised concerns about the potential chaos that could ensue if only the justices who ruled against Lee were impeached, which could lead to a paralysis of the Supreme Court. He noted that the justices are already under pressure, and the unique circumstances surrounding Lee's case could complicate judicial processes further.

Professor Han Sang-hoon argued that the National Assembly's pressure on the judiciary stems from the Supreme Court's hasty ruling in Lee's case. He criticized the court for making a decision that directly assessed the facts of the case rather than focusing on legal interpretations, which is typically the role of the appellate court. He also pointed out that the expedited ruling raises suspicions of political motives, as it could disenfranchise a leading opposition candidate.

Investigations have revealed that Moon Jae-in's daughter, Moon Da-hye, was a member of both the Democratic Party and the Justice Party during her father's presidency. The National Police Agency's investigation uncovered that the head of the National Security Office advised her to resign from the Democratic Party after concerns arose about the potential negative impact on the president's administration due to her dual membership. 

According to the indictment submitted by the Ministry of Justice, the situation escalated when Moon Da-hye's membership in the Justice Party was widely reported in January 2018, raising suspicions about her dual affiliation. A prosecutor stated that evidence confirming her membership in the Democratic Party was obtained through seizures, noting that belonging to multiple parties is illegal, but they did not pursue charges due to the statute of limitations.

The investigation also indicated that Moon Jae-in assisted his son-in-law, Seo Mo, in securing various jobs as the couple faced financial difficulties. The indictment detailed that in February 2016, after Seo failed repeatedly in law school admissions and his marriage deteriorated, Moon Jae-in facilitated his employment at 'Tori Games' through a former administrative officer from his administration.

Despite a monthly salary of 2.6 million won, the couple struggled to meet their average monthly expenses of over 6 million won, relying on 4 million won in monthly support from Seo's mother. However, as her financial situation worsened, the support ceased, and by late January 2018, the couple's total savings dwindled to just 2 million won.

Subsequently, Moon Jae-in helped Seo secure a position at Thai low-cost airline Thai AirAsia, where he earned a total of 217 million won from August 2018 to April 2020. Prosecutors have classified this payment as a bribe to Moon Jae-in. The Presidential Security Service reported Seo's employment and the security plans for Moon Da-hye's family in Thailand to the former president, who approved them.

On April 24, the Jeonju District Prosecutor's Office indicted Moon Jae-in on bribery charges without detention, alongside former lawmaker Lee, who allegedly provided favors to the family. Moon Da-hye and Seo received deferred prosecution. In response, Moon Jae-in criticized the investigation as politically motivated, claiming it was designed to harass and humiliate him and his family. He has since filed complaints against the prosecutors involved for abuse of power and leaking information.

In light of these developments, lawmaker Joo Jin-woo stated that if Moon Jae-in and the Democratic Party had any sense of shame, they should apologize to the public, criticizing their attempts to intimidate the judiciary and prosecutors with threats of impeachment and legal action.

He cautioned against underestimating thyroid cancer, stating, 'Some people say it's a benign cancer, but that's not true. If it spreads, it can become serious. Many people take thyroid cancer lightly, but my research shows otherwise.' Jin credited his wife, Park Si-eun, as his lifesaver, explaining, 'I almost skipped this health check-up after 44 years, but Si-eun dragged me into the fitting room and insisted I go. I can't live without her.' 

Park Si-eun chimed in, 'I did persuade him to get the check-up for our 10th wedding anniversary. It was necessary, right?' Jin agreed, encouraging others to prioritize their health as well. 

He also shared a personal anecdote, mentioning that fellow actor Jin Sun-kyu and his wife had also undergone health check-ups around the same time, adding, 'I didn't even tell Sun-kyu about my diagnosis. Only a few people, including our team and parents, knew about it.'
